2. Services
Data Pro Communications primarily provides professional low-voltage and technology integration services for commercial, managed-property and other professionally scoped projects, including selected larger residential projects when appropriate.
Services are subject to availability, site conditions, project requirements, and the applicable proposal or contract.
3. Estimates and Proposals
Estimates and proposals are generally valid for 30 days unless otherwise stated.
Pricing may change due to site conditions, material availability, scope changes, permitting requirements, or unforeseen conditions. Project-specific proposal or contract terms control when they differ.
4. Payments and Billing
Payment terms are stated in the applicable proposal, invoice, or contract. Payments are due according to those documents.
Late payments may be subject to fees or interest when stated in the applicable documents and legally permitted.
5. Payment Methods and Processing Fees
Available payment methods and any applicable processing fees will be stated in the applicable proposal, invoice, payment portal, or contract.
All payments must be made in United States dollars unless the controlling project document states otherwise.
6. Deposits
Deposits may be required to secure scheduling, order equipment, support procurement, or initiate work.
Project-specific deposit application and refund terms are controlled by the applicable proposal, invoice, or contract. No universal deposit percentage applies.
7. Equipment Procurement
Special-order, custom, or non-stock items may have restricted return or refund status after ordering. Manufacturer restocking fees may apply.
The applicable proposal or contract governs project-specific procurement and cancellation terms.
8. Refunds
Completed labor, installed equipment, configured systems, and specially procured items may be non-refundable depending on the project-specific terms.
Refund requests may be reviewed case by case under the applicable proposal, invoice, or contract.
9. Chargebacks and Payment Disputes
Unauthorized chargebacks involving approved proposals, completed work, delivered equipment, or rendered services may be disputed and may be subject to collections, recovery of authorized fees, or legal action as permitted by law.
10. Project Acceptance
Project completion, system testing, client walkthrough approval, written acceptance, payment, or continued use of installed systems may constitute acceptance when consistent with the applicable proposal or contract.
11. Warranties
Manufacturer warranties are governed by the original manufacturer.
Data Pro Communications may provide a limited workmanship warranty on qualifying work when specified in the applicable proposal or contract. No universal warranty duration is created by these Terms.
12. Warranty Exclusions
Warranty coverage may exclude misuse, unauthorized modifications, power surges, lightning, vandalism, natural disasters, improper maintenance, third-party equipment, internet service provider issues, and other conditions outside Data Pro Communications' control, as stated in the applicable warranty or project document.
13. Service Limitations
System performance may be affected by internet service, power quality, existing infrastructure, building conditions, environmental conditions, and third-party systems.
No system or service guarantees prevention, uninterrupted operation, identification, connectivity, or a particular outcome.
14. Limitation of Liability
To the fullest extent permitted by law, Data Pro Communications shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of its services or equipment.
15. Third-Party Systems
Data Pro Communications is not responsible for the performance, downtime, or failures of third-party products, software, cloud services, manufacturers, internet service providers, or other external systems.
16. Scheduling and Delays
Project timelines are estimates and may be affected by permitting, inspections, material availability, weather, third parties, or unforeseen conditions.
Responsibility for delays and any related schedule adjustments is governed by the applicable proposal or contract.
17. Site Access and Responsibilities
Clients are responsible for providing safe and timely site access, suitable work conditions, and required site availability, including access to power where applicable.
Additional charges for project-caused delays or rescheduling may apply when authorized by the applicable proposal or contract. These Terms do not create an automatic flat fee.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved in the courts located in Orlando, Florida.
19. Changes to Terms
Data Pro Communications may update these Terms periodically. The current version will be posted online.
